의사 리웬량은 첼시 매닝이나 에드워드 스노든과 같은 우리 시대의 진정한 영웅이다. 그는 코로나 바이러스를 처음 발견했지만 당국의 검열을 받다 죽음에 이르렀다. 그의 죽음은 공분을 일으키기에 마땅하다. 중국 정부가 전염병에 대응한 방식은 베르나 유의 다음 문장에 잘 묘사되어 있다. “중국에 표현의 자유가 있었다면 코로나 바이러스도 없었을 것이다. 중국 국민들의 표현의 자유와 기본권이 존중되지 않는다면 이러한 위기는 반복될 뿐이다. 중국의 인권은 다른 나라들에 비하면 멀었다. 정부가 국민을 계속 억압한다면 재난은 또 발생할 것이다. 국제 사회는 이 문제를 심각하게 받아들여야 한다.”(1)

현재 중국 국가기구의 모든 기능은 마오의 오래된 모토인 “인민을 신뢰하라”에 사실상 반대하고 있다. 인민을 신뢰할 수 없다는 기본 전제를 깔고 있다. 인민은 사랑받고, 보호받고, 돌봄의 대상일지 모르지만 신뢰할 수는 없다는 것이다. 이러한 불신은 중국 정부가 생태운동이나 노동자의 건강 문제에 대처할 때 보여준 것과 같은 입장의 반복이다. 중국 당국은 점점 더 특정 절차에 의지하고 있다. 몇 주 동안 종적을 감춘 생태운동가, 마르크스주의자 학생들, 인터폴의 책임자, 종교인, 홍콩의 출판가, 심지어 인기 영화배우 같은 사람들 조차 당국이 고발한 후에나 공개적으로 모습을 드러낼 수 있었다. 이 긴 침묵의 기간은 다음과 같은 메세지를 전달한다. “권력은 불가해하고 아무것도 증명할 필요가 없다. 이런 기본적인 메세지가 전달된 후에야 법적 합리화가 따라나온다.” 모든 사라진 개인들이 정부에 위협이 됐지만 특히 마르크스주의 학생들이 중국의 공식 이데올로기를 무기로 자신들의 비판 행위를 정당화했다는 점은 중요하다.

노동자와 학생의 수평적 연대로 이뤄진 자치조직이 당과 군부의 중견 간부들에게 공감을 불러 일으키자 당 지도부는 혼란에 빠졌다. 마르크스의 유령과도 같은 이러한 연대가 당 규범의 정당성을 협잡으로 비난하며 손상시키고 있기 때문이다. 지난 몇 년 동안 마오주의 웹사이트들이 폐지됐고 대학의 마르크스주의 토론 그룹은 금지됐다. 지금 중국에서 가장 위험한 일은 그 자신의 공식 이데올로기를 진심으로 믿고 따르는 것이 되어 버렸다. 중국 정부는 현재 대가를 치르고 있는 중이다.

홍콩의 저명한 공중보건학자 가브레엘 렁은 이렇게 말한다. “통제하지 못할 경우, 코로나 바이러스는 전 세계 인구의 3분의 2를 감염시킬 수 있다. 전문가들이 이 새로운 불확실한 돌발상황에 대처하는 동안에 대중은 정부에게 믿음과 신뢰를 가져야한다. 소셜 미디어에 가짜 뉴스와 진짜 뉴스가 뒤섞여 난무하는 이런 아무도 믿을 수 없는 상황에 어떻게 전염병과 싸울 수 있겠나? 추가적인 신뢰, 연대, 의지 등이 모두 절실히 필요하다.”(2)

리웬량은 사망 직전 병상에서 건강한 사회라면 하나 이상의 목소리가 있어야 한다고 말했다. 다른 목소리에 대한 긴급한 요구가 꼭 서구의 다당제 민주주의를 의미하는 것은 아니다. 비판적인 시민들의 목소리가 나올 수 있는 열린 공간이 필요하다는 것이다. 패닉 상황을 막기 위해 루머들을 통제해야한다는 정부의 발상이 오히려 불신을 조장하고 음모론을 퍼트리고 있다. 이에 맞서는 보통 사람들과 정부의 상호 신뢰만이 해결책을 제시할 수 있다.

전염병이 대규모로 퍼지는 시대에는 군사적 조치(검역소같은)를 수행할 수 있는 강력한 정부가 요청된다. 중국은 과거 수천만 명을 격리할 수 있었다. 똑같은 일이 미국에서 벌어진다면 동일한 조치를 취할 수 있을까? 검역소는 국가의 음모라고 의심하는 자유지상주의자들이 자신들만의 방법을 찾기 위해 무기를 들지 않을까? 더 많은 표현의 자유로 돌발상황에 대처할 것인가, 아니면 중국처럼 후베이를 희생시켜 세상을 구할 것인가. 어찌 보면 둘 다 맞다. 그러나 상황을 더욱 악화시키는 것은 ‘나쁜’ 소문들에서 ‘좋은’ 표현의 자유만 분리시킬 수 있는 방법은 없다는 것이다. 중국 당국이 “루머가 사실처럼 퍼지고 있다”고 불평할 때, 우리는 이미 공식 매체와 방대한 인터넷 뉴스 영역은 루머로 가득차 있다는 사실을 지적해야 한다.

정작 지독한 루머를 전파하는 곳은 최근 코로나 바이러스 음모론을 다루는 정기 코너를 신설한 러시아 국영 TV 채널 원의 메인 이브닝 뉴스인 브레먀(Vremya, 러시아어로 Time)다. 이 코너의 모호한 보도 스타일은 정설을 훼손하는 것처럼 보이며 시청자들에게 진실의 핵심에 접근한 인상을 준다. 바이러스 전염에 음흉한 서구 엘리트들(특히 미국)이 관련되어 있다는 식이다. 사실로 받아들이기에는 미친 소리같지만 혹시나..? (3) 라는 느낌을 주며 의심이 퍼져 나간다. 실제적 진실을 막더라도 상징적 효능감은 사라지지 않는다. 게다가 더 많은 희생자를 초래하는 혼란을 막기 위해 온전한 진실을 대중에게 얘기하지 않는 편이 낫다는 식으로 회피해서는 안된다. 이런 수준에서는 결코 문제를 해결할 수 없다. 유일한 탈출구는 사람들과 국가기구가 상호 신뢰의 길을 찾는 것이다. 바로 이것이 현재 중국이 놓치고 있는 점이다.

전염병이 전세계로 퍼질 때, 시장은 혼돈과 기아를 해결하기에 충분치 않다는 사실을 아는가? 공산주의자로서 우리는 이 문제를 글로벌한 수준에서 강구해야 한다. 생산과 분배의 조정은 시장의 조정 밖에서 이루어져야 한다. 수백만 명의 사망과 강제 이주를 야기했던 아일랜드 감자 대기근(1840년 대)을 떠올려 보라. 수많은 사람들이 고통받고 있는 와중에도 아일랜드의 식량 수출은 계속되고 있었고, 영국 정부는 시장이 해결해줄 것이라는 믿음을 고수하고 있었다. 이같은 잔인한 해결책을 더 이상 용납해서는 안된다.

코로나 바이러스 사태를 H.G. 웰스의 우주전쟁(The War of The Worlds, 1897)의 역전된 버전으로 읽어보자. 화성인의 지구 정복에 필사적으로 맞서 싸운 주인공은 지구의 병원체에 면역력이 없어 몰살당한 화성인들의 시체를 바라보며 이렇게 얘기한다. “인간의 모든 노력이 실패한 후, 지혜로운 신은 이 땅에 가장 하찮은 존재를 남겨두어 화성인들을 몰살시키셨도다”. 웰스는 이 소설을 그의 형 프랭크가 들려준, 호주 태즈메이니아 섬의 원주민들에게 가해진 영국의 궤멸적 침공에 대한 얘기를 듣고 구상했다고 한다. 그는 영국인들이 원주민들에게 한 일을 화성인이 지구에 한다면 어떻게 될까라고 생각했다. 태즈메이니아인들에게는 안타깝게도 그들의 침략자를 무찌를 병원체가 없었지만 말이다.(4) 웰스의 소설에서 인류를 대량살육할 치명적 전염병은 지구의 삶을 무자비하게 착취하고 파괴하는 화성인 침략자로 전환된다. 그러나 화성인 침략자는 바로 우리 자신이다. 우리가 우리 자신으로부터 지켜내려한 인간성을 위한 모든 노력은 실패로 돌아가고 말았다. 지금 우리는 “지혜로운 신이 이 땅에 남겨두신 가장 하찮은 존재”에 의해 위협받고 있다. 이 멍청한 바이러스는 맹목적으로 스스로를 재생산하고 변이시키고 있다.

우리는 물론 코로나 바이러스를 만들어낸 사회적 조건들을 분석해야한다. 모든 것이 상호 연결된 세계에서 한 영국남자가 싱가포르에서 회의를 하고 다시 영국으로 귀국 후 스키를 타러 프랑스로 가서 네 명을 더 감염시킨 상황을 생각해보자. 통상적으로 글로벌 마켓 따위를 문제의 원인으로 지목할 수 있겠지만, 그럼에도 불구하고 우리는 현재 진행중인 전염병이 다른 형태의 지구에서의 삶을 무자비하게 착취하는 인간성에 대한 처벌이라고 뭔가 더 심오한 의미를 부여하고 싶은 유혹에 저항해야한다. 우리가 그런 숨겨진 의미를 찾으려고 한다면 우주를 대화의 상대로 보는 전근대에 머물러 있는 것이다. 심지어 이런 위협 상황에서조차도 우주(혹은 저 세상 누군가)가 우리를 지켜보며 처벌하고 있는 것이라는 모종의 안도감마저 갖게 된다. 그러나 진짜로 받아들이기 힘든 것은 현재 진행되는 전염병이 그저 순수한 자연의 산물이라는 점이다. 거기엔 어떤 깊은 의미도 없다. 더 큰 사물의 질서에서 보면 인간은 특별한 존재가 아니다.

이스라엘의 총리 네타냐후는 코로나 바이러스라는 돌발상황이 발생하자 팔레스타인 당국에 즉각적인 구호와 물자를 제공했다. 이런 행동은 선의나 인간적 배려가 아니라 유대인과 팔레스타인인을 분리하는게 불가능하다는 단순한 사실에서 나온 것이다. 한 그룹이 감염되면 다른 그룹도 반드시 감염된다. 이것이 바로 우리가 정치로 전환해야할 리얼리티다. 지금은 “아메리카(또는 뭐든지 다른 국가) 퍼스트” 같은 주장이나 하고 있을 때가 아니다. 마틴 루터 킹은 반세기 전 이렇게 꼬집었다. “과거 우리는 모두 다른 배를 타고 왔지만 지금은 같은 배를 타고 있다.” 그렇다. 지금 당장 이렇게 행동해야 한다. 그렇지 않으면 우리는 다이아몬드 프린세스라는 이름의 배에서 끝장이 날 것이다.

WE’RE ALL IN THE SAME BOAT NOW – AND ITS NAME IS DIAMOND PRINCESS

Li Wenliang, the doctor who first discovered the ongoing epidemics and was censored by authorities, was an authentic hero of our time, something like the Chinese Chelsea Manning or Edward Snowden, so no wonder that his death triggered widespread anger. The predictable reaction to how the Chinese state deals with the epidemics is best rendered by Verna Yu’s comment “If China valued free speech, there would be no coronavirus crisis”:

“Unless Chinese citizens’ freedom of speech and other basic rights are respected, such crises will only happen again. /…/ Human rights in China may appear to have little to do with the rest of the world but as we have seen in this crisis, disaster could occur when China thwarts the freedoms of its citizens. Surely it is time the international community takes this issue more seriously.”

True, one can say that the whole functioning of the Chinese state apparatus runs against old Mao’s motto “Trust the people!” – it is based on the premise that one should NOT trust the people: the people should be loved, protected, taken care of… but not trusted. This distrust is just the culmination of the same stance displayed by the Chinese authorities when they are dealing with reactions to ecological protests or problems with workers’ health. Chinese authorities more and more seem to resort to a particular procedure: a person (an ecological activist, a Marxist student, the chief of Interpol, a religious preacher, a Hong Kong publisher, even a popular movie actress) just disappears for a couple of weeks (before they reappear in public with specific accusations raised against them), and this protracted period of silence delivers the key message: power is exerted in an impenetrable way where nothing has to be proven, legal reasoning comes afterwards when this basic message is taken… But the case of disappearing Marxist students is nonetheless specific: while all disappearances concern individuals whose activities can be somehow characterized as a threat to the state, the disappearing Marxist students legitimize their critical activity by a reference to the official ideology itself.

What triggered such a panicky reaction in the Party leadership was, of course, the spectre of a network of self-organization emerging through direct horizontal links between groups of students and workers, and based in Marxism, with sympathy in some old party cadres and even parts of the army. Such a network directly undermines the legitimacy of the Party rule and denounces it as an imposture. No wonder, then, that, in the last years, closed down many “Maoist” websites and prohibited many Marxist debate groups at universities – the most dangerous thing to do today in China is to believe in and take seriously the official ideology itself. China is now paying the price for such stance:

“The coronavirus epidemic could spread to about two-thirds of the world’s population if it cannot be controlled, according to Hong Kong’s leading public health epidemiologist Gabriel Leung. People needed to have faith and trust in their government while the uncertainties of the new outbreak were worked out by the scientific community, he said, “and of course when you have social media and fake news and real news all mixed in there and then zero trust, how do you fight that epidemic?” You need extra trust, extra sense of solidarity, extra sense of goodwill, all of which have been completely used up.”

There should be more than one voice in a healthy society, said doctor Li from his hospital bed just prior to his death, and this urgent need for other voices to be heard does not necessarily mean the Western type of multiparty democracy, it just calls for an open space for citizens’ critical reactions to be heard. The chief argument against the idea that state has to control rumors to prevent panic is that this control itself spreads distrust and thus creates even more rumors of conspiracies – only a mutual trust between ordinary people and the state can do the work.

A strong state is needed in times of epidemics since large-scale measures have to be performed with military discipline (like quarantine). China was able to quarantine tens of millions, and we should just imagine the same massive epidemics in the US – would the state be able to enforce the same measures? One can bet that thousands of libertarians with arms would fight their way out suspecting that the quarantine is a state conspiracy… So would it have been possible to prevent the outbreak with more freedom of speech, or is China now sacrificing Hubei to save the world? In some sense, both versions are true, and what makes things even worse is that there is no easy way to separate the “good” freedom of speech from the “bad” rumours. When critical voices complain that “the truth will always be treated as a rumour” by the Chinese authorities, one should add that the official media and the vast domain of digital news are already full of rumors.

A blistering case of rumours was provided one of the main Russian national TV networks, Channel One, which launched a regular slot devoted to coronavirus conspiracy theories on its main evening news programme, Vremya ("Time"). The style of the reporting is ambiguous, appearing to debunk the theories while leaving viewers with the impression that they contain a kernel of truth. The message (shadowy Western elites and especially the US are somehow ultimately to blame for coronavirus epidemics) is thus propagated as a doubtful rumour: it’s too crazy to be true, but nonetheless, who knows… The suspension of actual truth strangely doesn’t annihilate its symbolic efficiency. Plus we should even nit shirk from the possibility that, sometimes, not telling the entire truth to the public can effectively prevent panic which could lead to further victims. At this level, the problem cannot be solved – the only way out is the mutual trust between the people and the state apparatuses, and this is what is sorely missing in China.

If a world-wide epidemics will develop, are we aware that market mechanisms will not be enough to prevent chaos and hunger? Measures that appear to most of us today as “Communist” will have to be considered on a global level: coordination of production and distribution outside the coordinates of the market. One should recall here the Irish potato famine from 1840s which devastated Ireland, with millions dead or compelled to emigrate. The British state retained their trust into market mechanisms, and Ireland was exporting food even when millions were suffering… A similar brutal solution is hopefully no longer acceptable today.

One can read the ongoing coronavirus epidemics as an inverted version of G.H.Wells’ The War of the Worlds (1897), the story of how Martians conquered earth, the desperate hero-narrator discovers that all the Martians have been killed by an onslaught of earthly pathogens to which they had no immunity: "slain, after all man's devices had failed, by the humblest things that God, in his wisdom, has put upon this earth". It is interesting to note that, according to Wells, the plot arose from a discussion with his brother Frank about the catastrophic effect of the British on indigenous Tasmanians. What would happen, he wondered, if Martians did to Britain what the British had done to the Tasmanians? The Tasmanians, however, lacked the lethal pathogens to defeat their invaders. Perhaps, epidemics which threaten to decimate humanity should be treated as Wells’ story turned around: the “Martian invader” ruthlessly exploiting and destroying life on earth are we ourselves, humanity, and, after all devices of highly developed primates to defend themselves from us had failed, we are now threatened “by the humblest things that God, in his wisdom, has put upon this earth," stupid viruses which just blindly reproduce themselves – and mutate.

We should of course analyze in detail social conditions which made the coronavirus epidemic possible – just think about how, in today’s interconnected world, a British guy meeting someone in Singapore returns to England and then goes skiing to France, infecting there four others… the usual suspects are waiting in line to be questioned: global capitalist market, etc. However, we should nonetheless resist the temptation to treat the ongoing epidemics as something that has a deeper meaning: the cruel but just punishment of humanity for the ruthless exploitation of other forms of life on earth or whatever… But if we search for such a hidden message, we remain premodern: we treat our universe as a partner in communication. Even if our very survival is threatened, there is something reassuring in the fact that we are punished – the universe (or even Somebody-out-there) is looking at us… The really difficult thing to accept is the fact that the ongoing epidemics is a result of natural contingency at its purest, that it just happened and hides no deeper meaning. In the larger order of things, we are a species which doesn’t matter.

Reacting to the threat posed by the coronavirus outbreak, Netanyahu immediately offered help and coordination to the Palestinian authority – not out of goodness and human consideration, but for the simple fact that it is impossible to separate Jews and Palestinians there – if one group is affected, the other will be inevitably also hit. This is the reality which we should translate into politics - now it’s the time to drop the “America (or whoever) first” motto. As Martin Luther King pout it more than half a century ago: “We may have all come on different ships, but we're in the same boat now.” If we don’t start to behave like that, we may well all end up on a ship called Diamond Princess.

오늘날의 맑스 : 종말은 우리가 상상할 수 없는 방식으로 가까이 와 있다

라디오 예레반(radio Erevan)¹⁾에 소련의 재밌는 농담이 소개됐다. 청취자가 “라비노비치가 복권에 당첨돼 새 차를 받았다는 게 사실입니까?고 묻자, 라디오 진행자는 “원칙적으로는 맞습니다. 그런데 새 차가 아니라 낡은 자전거입니다. 그리고 원래 도난당했던 겁니다.”고 답했다고 한다. 이 농담은 맑스 출생 후 200년이 지난 지금 그의 가르침에도 똑같이 적용되지 않을까? 라디오 예레반에 물어보자. “맑스는 지금도 여전히 유효한가요?” 답변은 다음과 같을 것이다. “원칙적으로는 맞지요. 맑스의 가르침은 한 세기 반²⁾이 지난 지금에서야말로 극에 다다른 자본주의 역동성의 미친 춤을 훌륭하게 설명하고 있지요. 그러나...”

제랄드 코헨³⁾은 고전적 맑스주의가 정의하는 노동계급을 구성하는 특성으로 다음 네 가지를 들었다. (1) 사회의 대다수를 형성한다. (2) 사회의 부를 생산한다. (3) 사회로부터 착취받는다. (4) 사회의 빈곤 계층이다. 이 네 가지를 결합하면 두 가지 특성이 더 나온다. (5) 노동계급은 혁명으로부터 잃을 게 없다. (6) 노동계급은 혁명적 사회 변혁에 참여할 수 있고 참여해야 한다. 그런데 오늘날엔 처음 네 가지 특성 중 어느 것도 노동계급을 대변하지 못한다. 이것이 (5), (6) 번이 발생하지 않는 이유이다(설령 부분적으로 적용되는 특성이 있더라도, 그들은 더 이상 단일한 행위자로 통합되지 못한다. 사회의 빈곤층은 더 이상 노동자들이 아니기 때문이다).

맑스주의의 역사적 교착은 자본주의의 최종 위기에 대한 예언 때문도 아니고, 자본주의가 어떻게 위기를 통해 더욱 강력해지는지에 대해 포착하지 못해서도 아니다. 볼프강 슈트렉⁴⁾이 정확한 용어로 기술했듯이 고전적 맑스주의에는 더 비극적인 실수가 있다. 맑스주의는 자본주의의 ‘최종 위기’(final crisis)에 대해선 맞았다. 우리는 지금 확실히 최후에 접어 들고 있다. 그러나 이 위기는 부패와 붕괴의 장기적 과정일 뿐이다. 자동적인 헤겔적 지양(止揚, Aufhebung)⁵⁾의 과정이란 없으며, 더 높은 수준의 사회 구성이라는 장을 향해 이러한 부패에 긍정적인 뒤틀림이나 변형을 가할 행위자도 없다.

“맑스주의자(보다 적절하게는 모더니스트)들의 편견은 자본주의는 더 나은 새로운 사회가 가시화되고 혁명적 주체가 인류의 진보를 위해 그것을 수행할 준비가 되어 있을 때만 그 역사적 시대로서 종말을 고한다는 것이었다. 이것은 신자유주의적 글로벌 혁명의 시대에 집단적 행위주체의 붕괴 이후, 그것을 진심으로 원하지만 꿈조차 꿀 수 없는 우리의 공통적 운명을 정치적으로 통제할 수 있다는 믿음을 전제로 한다.”

맑스의 비전은 사회가 점점 최종 위기로 치닫고 있기 때문에, 모든 사회적 혼란은 자본가와 다수 프롤레타리아라는 하나의 커다란 적대로 단순화된다는 것이었다. 그러나 20세기 공산주의 혁명을 살펴 봐도 이런 단순화는 전혀 일어나지 않았다. 래디컬한 공산주의 운동은 항상 소수의 선봉으로 제한되었고, 헤게모니를 잡기 위해 위기 상황(주로 전쟁)을 참을성 있게 기다리며 기회를 엿봐야 했다. 그러던 순간 마침내 진정한 선봉이 인민을 동원해 상황을 장악한다. 코뮤니스트는 절대 독단적일 수 없다. 대지와 평화를 사랑하고(러시아의 경우), 부패를 철폐하고 민족의 해방과 통합을 도모한다(중국의 경우)는 주제와 함께 가야한다. 그들은 인민동원이 오래가지 못한다는 것을 잘 알고 있었기 때문에 권력을 유지하기 위한 기구를 주의 깊게 준비하고 있었다(노골적으로 농민을 부차적 연대로 취급한 10월 혁명과 대조적으로, 중국 혁명은 프롤레타리아인 척 조차 하지 않고 농민을 곧장 혁명의 기초 세력으로 호명했다).

서구 맑스주의(또는 맑스주의 전체)의 문제는 혁명주체의 부재였다. 노동계급이 그 내부로부터 그 자신을 스스로 위하는 통로를 완성하지 못하는 이유는 무엇인가. 어떻게 그들 스스로 혁명적 주체로 구성할 수 있을까. 이 질문은 노동자들의 계급의식(사회적 실존으로서 노동계급)의 형성을 방해하는 무의식적 리비도의 메커니즘을 설명할 수 있도록 적절한 레퍼런스를 제공하는 정신분석의 존재 이유(raison d’etre)가 된다. 정신분석을 통해 맑스주의 사회경제 분석의 진실은 구원받는다. 여기에 중간계급의 부상따위의 수정주의적 이론같은 것은 필요없다. 같은 방식으로 서구 맑스주의는 혁명주체의 역할을 수행할 수 있는 또 다른 사회주체(노동계급으로 불리는 것을 꺼려하는)에 대한 연구를 진행 중이다. 제 3세계 농민들, 학생과 지식인들, 소외된 주변인들... 이 아이디어의 최신 버전은 난민 문제로 연결된다. 엄청난 수의 난민 유입이 유럽의 래디컬 좌파들에게 다시 행동할 것을 요청하고 있다. 급증하는 반대자들의 폭력에 맞서 이민자들을 혁명주체가 될 수 있도록 해외에서 아웃소싱하자. 이민자들이 잃어버린 노동계급의 빈자리를 채울 것이다. 외설적이고 냉소적인 이런 아이디어는 완전히 정신나간 얘기로 들릴 지도 모른다.

혁명주체로서 노동계급의 실패라는 문제는 이미 볼셰비키 혁명의 핵심이었다. 레닌의 기지(Lenin’s art)는 실망한 농민들의 ‘잠재적 분노’(슬로터다이크⁶⁾)를 감지했다는 것이다. 10월 혁명의 승리는 방대한 농민들이 급진적으로 분노한 순간을 놓치지 않고 그들에게 헌사된 ‘대지와 평화’라는 슬로건에 기인한 것이었다. 레닌은 이 문구를 이미 십 년 앞서 생각했다. 이것이 레닌이 독립 농민을 새로운 강력한 계급으로 창조하는 걸 목표로 하는 스톨리핀 토지개혁(the Stolypin land reforms)⁷⁾의 성공을 예상하며 공포에 질린 이유다. 스톨리핀이 성공한다면 혁명의 기회는 수십 년간 다시 오지 않을 것이다.

쿠바에서 유고슬라비아까지 모든 사회주의 혁명의 성공은 극단적인 위기 상황에서 기회를 포착하고 ‘민족 해방’과 ‘자본에 대한 분노’를 흡수하는 모델을 따랐다. 물론 헤게모니 논리의 선봉대(partisan)는 이것이 ‘정상적인’ 혁명의 논리이며, ‘비판적 대중’은 언제나 특정한 급진적인 상황에서 터져나온 요구들에 부합하는 일련의 등가성이 준비될 때만 형성된다는 것을 알고 있었다. 혁명은 모든 적대가 하나의 큰 지점으로 붕괴될 때가 아니라 적대가 힘과 시너지를 일으키며 결합될 때 일어난다.

요점은 혁명이 더 이상 역사의 기차에 올라타거나 역사의 법칙을 따르지 않는다는 것이다. 역사는 없다. 역사는 우발적인 요소들이 마주치며 열려있는 과정이다. 문제는 다른 데 있다. 혁명은 마치 역사의 법칙이 존재하는 것처럼, 지배적인 역사발전의 중심이 있는 것처럼, 시류를 거스르는 역사의 틈새에서만 일어난다. 혁명가는 인내심을 가지고 시스템이 공개적으로 오작동하거나 붕괴할 때(보통 아주 짧은 순간인)를 기다리고, 기회를 포착하고, 그 순간 마치 거리에 널려있는 것마냥 권력을 거머 쥐고 힘을 강화하여 권력기구를 설립해야한다. 그리하여 혼돈의 시간이 지나 다수의 주류가 정신을 차려보면 새로운 체제가 나타났다는 것을 깨닫고 실망할 것이다. 확고히 자리잡은 그것을 제거하기엔 이미 늦었다. 코뮤니스트들은 또한 대중 동원을 끝낼 정확한 순간을 신중히 계산해야 한다. 유토피아를 실현하는데 의심할 바없는 요소를 지녔던 중국 문화혁명의 경우를 보자. 혁명의 막바지, 마오가 동요를 제압(이미 상층 노멘클라투라의 경쟁을 제거하고 완전히 권력을 장악했다)하기 전에, 백만 노동자들이 국가와 심지어 당 자체도 없애고 직접 소통하는 사회조직을 요구하는 상하이 코뮌⁸⁾이 존재했다. 마오가 군대를 개입시켜 질서를 회복하라고 명령한 것은 바로 이 지점에서 중요하다. 역설은 통제되지 않은 대변동을 촉발시킨 지도자의 역할이다. 그는 극단적인 독재와 대중의 극단적인 해방이 겹치는 완전히 개인적 권력을 행사하려고 했다.

글로벌 자본주의 시대에 맑스의 정치경제 비판이 여전히 타당한가에 대한 질문은 그래서 정확히 변증법적으로 답해야한다. 맑스의 정치경제 비판뿐 아니라, 그가 자본주의 역학에 대해 그린 윤곽은 지금도 완전히 유효하다. 우리는 여기서 더 나아가 그것은 글로벌 자본주의 시대인 오늘날 더욱, 헤겔식으로 말하자면 현실이 비로소 맑스가 그린 그 개념의 윤곽에 도달했다고 말해야한다. 그러나 여기서 정확히 변증법적 역전이 개입한다. 자본주의가 완전히 유효한 바로 그 지점에서 자본주의의 한계는 사라진다. 승리의 순간이 패배의 순간이다. 외부의 장애물을 극복한 후 새로운 위협이 내재한 모순의 신호를 보내며 그 내부로부터 출현할 것이다. 현실이 개념에 완전히 도달할 때 개념은 변화될 것이다. 바로 여기에 정확히 변증법적 역설이 있다. 맑스는 단순히 틀린게 아니다. 그는 종종 옳았지만 그가 기대했던 것보다 더 문자 그대로 옳았던 것이다.

그래서 결론이 뭔가? 맑스의 텍스트들을 더 이상 새로울 것 없는 흘러간 시대에 대한 흥미로운 기록으로 일축해야하는 것일까? 정확히 변증법적 역설로 말한다면, 20세기 코뮤니즘의 교착과 실패, 그리고 맑스적 전망의 한계에 뚜렷히 놓여있는 난국과 동시에 그것의 유효함을 여실히 목격하는 것이다. 고전적 맑스의 해법은 실패했지만 문제는 여전히 남아있다. 오늘날 코뮤니즘은 더 이상 해법이 아니라 문제의 이름이다. 모든 차원의 공통적인 것, 삶의 핵심으로서의 자연이라는 공통적인 것, 생태유전이라는 공통적인 것, 문화적으로 공통적인 것(특히 지적 재산권), 그리고 무엇보다 누구도 배제되지 않는 인본주의적 보편 공간으로서 공통적인 것이라는 문제가 남아있다. 해법이 무엇이든 코뮤니즘은 이런 문제들을 다뤄야 한다.

맑스가 폴 라파그⁹⁾에게 한 “Ce qu'il y a de certain, c'est que moi je ne suis pas marxiste”¹⁰⁾이란 말을 소비에트어로 번역하면 “이게 맑시즘이라면 나는 맑시스트가 아니다”다. 이 오역은 변형된 맑스주의를 완벽하게 보편 담론으로 만들어 준다. 소비에트 맑스주의에서는 맑스 그 자신 조차도 맑스주의를 구성하는 똑같은 보편 지식에 참여하는 맑스주의자다. 그가 훗날 “맑스주의”라고 알려진 가르침을 창조했다는 사실은 확고부동하다. 따라서 그의 부인은 그 가르침 자체를 “맑스주의자”로 잘못 선언하는 경우를 일컫는 것이다.

맑스가 의미한 것은 훨씬 더 급진적이었다. 어떤 갭이 그 자신이 창조한 가르침에 본질적인 관계를 맺고 있는 맑스와 이 가르침을 따르는 맑스주의자를 분리시킨다. 유명한 맑스 형제(Marx brothers)¹¹⁾의 농담을 보자. “당신은 임마뉴엘 라벨리와 꼭 닮았군요. 하지만 제가 임마뉴엘 라벨리인데요? 아 그래서 꼭 닮은 거군요.” 라벨리라 불리는 사내는 라벨리와 닮은 게 아니라 그냥 라벨리다. 이와 똑같이 맑스 그 자신은 맑시스트 중 한 명이 아니라 다른 맑스주의자들을 만들어 낸 준거점들의 핵심이다. 지금 맑스에 충실할 유일한 방법은 더 이상 맑스주의자가 되는 것이 아니라 맑스 기저의 몸짓(Marx’s grounding gesture)을 새로운 방법으로 반복하는 것이다.

Marx Today: The End Is Near… Only Not the Way We Imagined It

There is an old delicious Soviet joke about radio Erevan: a listener asks “Is it true that Rabinovitch won a new car on lottery?”, and the radio answers: “In principle yes, it’s true, only it wasn’t a new car but an old bicycle, and he didn’t win it but it was stolen from him.” Does exactly the same not hold for the fate of teaching of Marx today, 200 years after his birth? Let’s ask radio Erevan: “Is Marx still actual today?” We can guess the answer: in principle yes, it describes wonderfully the mad dance of capitalist dynamics which reached its peak only today, more than a century and a half later, but… Gerald A. Cohen enumerated the four features of the classic Marxist notion of the working class: (1) it constitutes the majority of society; (2) it produces the wealth of society; (3) it consists of the exploited members of society; (4) its members are the needy people in society. When these four features are combined, they generate two further features: (5) the working class has nothing to lose from revolution; (6) it can and will engage in a revolutionary transformation of society. None of the first four features applies to today’s working class, which is why features (5) and (6) cannot be generated. (Even if some of the features continue to apply to parts of today’s society, they are no longer united in singe agent: the needy people in society are no longer the workers, etc.)

The historical deadlock of Marxism resides not only in the fact that it counted on the prospect of capitalism’s final crisis, and therefore couldn’t grasp how capitalism came out of each crisis strengthened. There is a much more tragic mistake at work in the classic body of Marxism, described in precise terms by Wolfgang Streeck – Marxism was right about the “final crisis” of capitalism, we are clearly entering it today, but this crisis is just that, a prolonged process of decay and disintegration, with no easy Hegelian Aufhebung in sight, no agent to give to this decay a positive twist and transform it into the passage to some higher level of social organization:

“It is a Marxist – or better: modernist – prejudice that capitalism as a historical epoch will end only when a new, better society is in sight, and a revolutionary subject ready to implement it for the advancement of mankind. This presupposes a degree of political control over our common fate of which we cannot even dream after the destruction of collective agency, and indeed the hope for it, in the neoliberal-globalist revolution.”

Marx’s vision was that of a society gradually approaching its final crisis, the situation in which the complexity of social life is simplified into one great antagonism between capitalists and the proletarian majority. However, even a quick look at the XXth century Communist revolutions makes it clear that this simplification never took place: radical Communist movements were always constrained to a vanguard minority, and in order for it to gain hegemony, it had to wait patiently for a crisis (usually war) which provided a narrow window of opportunity. In such moments, an authentic vanguard can seize the day, mobilize the people (even if not the actual majority) and take over. Communists were here always utterly “non-dogmatic,” ready to parasitic on another issue: land and peace (Russia), national liberation and unity against corruption (China)… They were always well aware that mobilization will be soon over, and were carefully preparing the power apparatus to keep them in power at that moment. (In contrast to the October Revolution which explicitly treated peasants as secondary allies, the Chinese revolution didn’t even pretend to be proletarian: it directly addressed farmers as its base.)

The problem of the Western Marxism (and even of Marxism as such) was the absence of the revolutionary subject: how is it that the working class does not complete the passage from in-itself to for-itself and constitute itself as a revolutionary agent? This problem provided the main raison d’etre of its reference to psychoanalysis which was evoked precisely to explain the unconscious libidinal mechanisms which prevent the rise of class consciousness inscribed into the very being (social situation) of the working class. In this way, the truth of the Marxist socio-economic analysis was saved, there was no reason to give ground to revisionist” theories about the rise of the middle classes, etc. For this same reason, the Western Marxism was also in a constant search for other social agents who could play the role of the revolutionary agent, as the under-study replacing the indisposed working class: Third World peasants, students and intellectuals, the excluded marginals… The latest version of this idea relates to the refugees: only an influx of a really large number of refugees can revitalize the European radical Left. This line of thought is thoroughly obscene and cynical: notwithstanding the fact that such a development would for sure give an immense boost to anti-immigrant brutality, the truly crazy aspect of this idea is the project to fill in the gap of the missing proletarians by importing them from abroad, so that we will get the revolution by a surrogate outsourced revolutionary agent.

The failure of the working class as the revolutionary subject lies already in the very core of the Bolshevik revolution: Lenin’s art was to detect the “rage potential”(Sloterdijk) of the disappointed peasants. October Revolution won due to the slogan “land and peace,” addressed to the vast peasant majority, seizing the short moment of their radical dissatisfaction. Lenin was thinking along these lines already a decade ago, which is why he was horrified at the prospect of the success of the Stolypin land reforms, which aimed at creating a new strong class of independent farmers – he wrote that if Stolypin succeeds, the chance for a revolution chance is lost for decades. All successful socialist revolutions, from Cuba to Yugoslavia, followed this model, seizing the opportunity in an extreme critical situation, co-opting the national-liberation or other “rage capitals.” Of course, a partisan of the logic of hegemony would here point out that this is the very “normal” logic of revolution, that the “critical mass” is reached precisely and only through a series of equivalences among multiple demands which is always radically contingent and dependent on a specific, unique even, set of circumstances. A revolution never occurs when all antagonisms collapse into the big One, but when they synergetically combine their power.

The point is not just that revolution no longer rides the train of History, following its Laws, since there is no History, since history is a contingent open process; the problem is a different one: it is as if there IS a Law of History, a more or less clear predominant main line of historical development, and that revolution can only occur in its interstices, “against the current.” Revolutionaries have to wait patiently for the (usually very brief) period of time when the system openly malfunctions or collapses, seize the window of opportunity, grab the power which at that moment as it were lies on the street, IS for grab, and then fortify its hold on power, building repressive apparatuses, etc., so that, once the moment of confusion is over, the majority gets sober and is disappointed by the new regime, it is too late to get rid of it, they are firmly entrenched. Communists were also always carefully calculating the right moment to stop popular mobilization. Let’s take the case of the Chinese Cultural Revolution which undoubtedly contained elements of an enacted utopia. At its very end, before the agitation was blocked by Mao himself (since he already achieved his goal of reestablishing his full power and getting rid of the top nomenklatura competition), there was the "Shanghai Commune": one million workers who simply took the official slogans seriously, demanding the abolition of the State and even the Party itself, and the direct communal organization of society. It is significant that it was at this very point that Mao ordered the army to intervene and to restore order. The paradox is that of a leader who triggers an uncontrolled upheaval, while trying to exert full personal power - the overlapping of extreme dictatorship and extreme emancipation of the masses.

The question of the continuing relevance of Marx’s critique of political economy in our era of global capitalism has thus to be answered in a properly dialectical way: not only is Marx’s critique of political economy, his outline of the capitalist dynamics, still fully actual, one should even make a step further and claim that it is only today, with global capitalism, that, to put it in Hegelese, reality arrived at its notion. However, a properly dialectical reversal intervenes here: at this very moment of full actuality the limitation has to appear, the moment of triumph is that of defeat, after overcoming external obstacles the new threat comes from within, signalling immanent inconsistency. When reality fully reaches up to its notion, this notion itself has to be transformed. Therein resides the properly dialectical paradox: Marx was not simply wrong, he was often right, but more literally than he himself expected to be.

So what is or result? Should we write off Marx’s texts as an interesting document of the past and nothing more? In a properly dialectical paradox, the very impasses and failures of the XXth century Communism, impasses which were clearly grounded in the limitations of Marx’s vision, at the same time bear witness to its actuality: the classic Marxist solution failed, but the problem remains. Communism is today not the name of a solution, but the name of a problem, the problem of commons in all its dimensions – the commons of nature as the substance of our life, the problem of our biogenetic commons, the problem of our cultural commons (“intellectual property”), and, last but not least, commons as the universal space of humanity from which no one should be excluded. Whatever the solution, it will have to deal with these problems.

In Soviet translations, Marx’s well-known statement to Paul Lafargue “Ce qu'il y a de certain, c'est que moi je ne suis pas marxiste,” was rendered as »If this is Marxism then I am not a Marxist.” This mistranslation renders perfectly the transformation of Marxism in a university discourse: in Soviet Marxism, even Marx himself was a Marxist, participating in a same universal knowledge that composes Marxism; the fact that he created the teaching later known as “Marxism” provides no exception, so his denial just refers to a specific wrong version that falsely proclaims itself “Marxist.” What Marx meant was something more radical: a gap separates Marx himself, the creator who has a substantial relationship towards his teaching, from “Marxists” who follow this teaching. This gap can also be rendered by the well-known Marx brothers joke “You look like Emmanuel Ravelli. – But I am Emmanuel Ravelli. – So no wonder you look like him.” The guy who is Ravelli doesn’t look like Ravelli, he simply is Ravelli, and, in the same way, Marx himself is not a Marxist (one among the Marxists), he is the point of reference exempted from the series - it is the reference to him that makes others Marxists. And the only way to remain faithful to Marx today is to no longer be a “Marxist” but to repeat Marx’s grounding gesture in a new way.

의제자본과 인격적 지배의 귀환*

맑스가 자본주의적 재생산에 대한 능가할 수 없는 분석을 제공한다 해도, 그의 실수는 그가 자본주의의 최종적인 와해에 대한 전망을 확신했다는 것이고, 그렇기 때문에 어떻게 자본주의가 강화된 각각의 위기에서 벗어나는지를 파악할 수 없었다는 데 있다. 볼트강 슈트렉에 의해 정밀한 용어로 기술된 바, 맑스주의는 우리가 오늘날 명백히 진입하고 있는 자본주의의 “최후 위기”에 대해선 옳았지만, 이러한 위기는 다만 쇠퇴 및 붕괴의 장기화된 과정이며, 헤겔적 지양Aufhebung 역시 쉽게 볼 수 없으며, 이러한 쇠퇴에 긍정적인 급변을 가하고, 그것을 어떤 더욱 고차적 수준의 사회적 조직화를 향한 통로로 변형시키는 행위주체도 없을 뿐이다.

새로운, 더 나은 사회가 시야에 나타나고, 혁명적 주체가 인류의 진보를 위하여 그것을 실행에 옮길 준비가 될 때만 역사적 시대로서의 자본주의가 종언을 고할 것이라는 것은 맑스주의적—아니 보다 적당히는 현대주의적modernist—편견이다. 이것은 우리가 집단적 행위주체성의 파괴 이후 꿈조차도 꿀 수 없는 우리의 공통의 운명에 대한 정치적 통제, 사실은 신자유주의적 지구주의적 혁명에서, 그것에 관한 희망을 전제로 한다.¹⁾

슈트렉은 이러한 쇠퇴의 다른 징후를 열거한다. 낮아진 이윤율, 부패와 폭력의 증가, 금융화(가치 생산에 기생하는 금융적 거래로부터의 이윤). 미국과 유럽연합의 금융정치의 역설은 의제자본의 운영에서 그것들이 대부분 사라지기 때문에 화폐의 거대한 투입이 생산을 발생시키는 데 실패한다는 것이다. 이것이 왜 폭발적으로 증가하는 부채를 복지국가의 비용 때문으로 보는 표준적인 자유주의적 하이에크적 해석을 거부해야하는가의 이유이다. 데이터는 그것의 대부분이 금융자본과 그 이윤을 공급하는 쪽으로 간다는 것을 입증한다.

이러한 쇠퇴의 예기치 않은 또 다른 결과가 존재한다. 레베카 카슨²⁾은 최근에 어떻게 자본의 금융화—잉여가치를 생산하는 노동력의 가치증식valorization(Verwertung)을 통한 우회 없이, M-M′(화폐–화폐′)에서 가장 많은 이윤이 발생되는 곳—가 역설적으로 직접적인 인격적 지배 관계의 귀환으로 이어지는지를 논의했다. 맑스가 강조했듯이, M-M′은 자본의 가장 인격적이고 추상적인 자본이라는 점에서, 이는 너무나 의외다. 여기서 핵심은 세 가지 요소들, 즉 의제자본fictitious capital, 인격적 지배personal domination, 그리고 노동력labor-power의 사회적 재생산social reproduction 사이의 연관성을 파악하는 것이다. 가치증식이라는 사실에 앞서서 금융투기가 이루어진다. 금융투기는 주로 화폐가 아직 생산에 쓰이지 않은 신용 운영과 투기적 투자금으로 이루어진다. 신용은 부채를 의미하고, 그러므로 이러한 운영의 주체들 또는 담지자들(단지 개인들뿐만 아니라 화폐를 관리하는 은행과 기관 역시)은 단지 가치형태에만 종속되는 것으로서 그 과정에 연루되지 않는다. 그들은 또한 채권자이고 채무자이며, 그래서 추상적 지배의 상품화를 기반으로 하지 않는 또 다른 형태의 권력 관계에 종속된다.

그러므로 여신업무(신용운영)에 관련된 특정한 권력 관계는 추상적 지배와 차별화된 인격적 차원의 종속 상태를 갖는다(신용-부채). 하지만, 여신업무(신용운영)의 사회적 관계는 가치형태의 사회적 관계를 기반으로 하므로, 이러한 인격적 권력 관계는 완벽하게 비인격적이고 형식적인 것으로서 맑스에 의해 추상적으로 기술되는 교환 과정 자체에 의해 성립된다. 그러므로 의제자본으로 인해 가치증식의 일시중지suspension의 방식으로 표면화되는 인격적 형태의 종속의 현상은 추상적 형태의 지배 또한 존재하지 않는다는 것을 의미하진 않는다.³⁾

의제자본에 내포된 권력의 동역학은 행위주체들 사이의 직접적인 이분법은 아닌 것처럼 보일 수도 있다. 규정상 인격적 지배가 직접적인 상호작용의 수준에서 발생하는 반면에, 채무자는 주로 개인들이 아니라 미래 생산에 관해 시세를 예측하여 주식을 사고 파는 하는 은행과 헤지펀드들이다. 그리고 사실상, 의제자본의 운영은 갈수록 더 직접적 개입 없이도, 즉 단순히 자신의 프로그램에서 작동하는 컴퓨터를 통해 이루어지고 있지 않은가? 하지만, 이러한 운영은 어쨌든 대인적 관계로 재번역되어야만 하고, 거기서 추상은 대면적 지배로서 나타난다.

직접적인 상품화에 종속되어 있지 않지만 노동력의 재생산에 핵심적인 역할을 수행하는 그들은 또한 의제자본의 유통에 의해 개방되기를 가정된 미래의 가치증식에 점증하는 의존에 의해 또한 영향을 받는다. 그러한 자본은 장래에 가치 증식이 일어날 것이라는 기대에 의해 지지되기 때문에, 노동력 재생산은 현재 노동에 종사하고 있지 않은 이들이 미래에 노동을 할 준비를 갖추도록 압박을 받는다. 이것이 교육이라는 주제가 왜 오늘날 너무나 중요하며, 또한 부채와 밀접하게 관련되어 있는지의 이유이다. 학생은 그/그녀의 교육에 대한 비용을 빚지게 되며, 이러한 부채는 빚진 학생이 직장을 잡았을 때 자아-상품화를 통해 상환할 것으로 예상된다. 교육은 또한 어떤 방식으로 난민들을 처리할 것인가에서—따라서, 어떤 방식으로 그들을 유용한 노동 인구로 만들 것인가—에서 주된 의제들 가운데 하나이다.

우리 사회에서, 자유로운 선택이 최상의 가치로 고양되고 있기 때문에, 사회적 통제와 지배는 더 이상 주체들의 자유에 대한 침해로서 나타날 순 없게 마련이다. 대신에, 통제와 지배는 자유로서의 개인들의 그야말로 자기-경험(에 의해 지탱되는 것)처럼 보여야만 한다. 그 정반대의 것을 가장하여 나타나고 있는 이러한 부자유의 다양한 형태들이 존재한다. 보편적 보건진료를 우리가 박탈당했을 때, 우리는 우리에게 새로운 선택의 자유, 즉 우리의 보건진료 제공자를 선택할 자유가 주어졌다는 이야기를 듣게 된다. 우리가 더 이상 장기고용에 의존할 수 없을 때, 매 2년마다 새로운 불안정한 지위를 찾도록 강요당할 때, 우리는 우리자신들을 재발명할 기회가 우리에게 주어졌으며, 그리고 우리의 인성 속에 숨어 있는 새로운, 뜻밖의, 창조적인 잠재성을 발견할 수 있다는 이야기를 듣곤 한다. 우리의 자녀의 교육비를 지불해야만 할 때, 우리는, 자신이 소유한(또는 빌려왔던) 재산을 어떤 방식으로—교육, 건강, 여행 등에—투자할지를 자유롭게 선택해야만 하는 자본가처럼 행동하는, 우리도 “자아의 기업가entrepreneurs of the self”가 된다는 이야기를 듣고 있다. 강제된 “자유로운 선택”에 의해 끊임없이 폭격당하고, 우리 대부분이 심지어 적절하게 자격을 갖고 있지도, 충분한 정보를 소유하고 있지도 않은 것들에 대해 결정을 내리도록 강요당하면서, 사실상 우리는 점점 더 우리의 자유를 우리에게서 변화의 진정한 선택을 빼앗아가는 짐으로서 경험하는 중이다. 일반적으로 부르주아 사회는 계급 차이에 의해서만 분할된 시장 주체들로서 모든 개인들을 평등하게 하면서, 카스트와 다른 위계질서를 제거한다고 알려져 있다. 그러나 “그 자생적인spontaneous” 이데올로기를 지닌, 오늘날의 후기자본주의는 우리들 사이의 차이는 단지 양적인 것으로(거대 자본가는 투자를 위해 수억 달러를 빌리고, 가난한 노동자는 보충 교육을 위해 몇 천 달러를 빌린다), 우리 모두를 “자기-기업가”로 자격화하는 방식으로, 계급 분할 자체를 제거하려 노력하고 있다.

많은 찬사를 받았던 “협력적 공유사회Collaborative Commons” 역시 여기서 [동일한] 역할을 수행한다. 맑스는 항상 노동자들이 상품으로서의 그들의 노동력의 충분한 가치를 (규칙으로서) 지불받게 된다는 의미에서 노동자와 자본가 사이의 교환은 “공정한” 것이라고 강조한다. 여기선 어떠한 직접적인 “착취”도 존재하지 않는다. 즉, 노동자들이 “자본가들에게 팔고 있는 상품의 가치를 모두 지불받지 못한다”는 것이 아니다. 따라서 시장 경제에서, 나는 사실상 여전히 의존적으로 남아 있을지라도, 이러한 의존은 그럼에도 불구하고 직접적인 예속 또는 심지어 물리적 강제의 형식 대신에, 나와 다른 사람들 사이의 “자유로운” 시장 교환의 형태로 벌어지는 것으로, “문명화”되었다. [유대인 러시아계 미국인 우익 소설가이자 극작가인] 에인 랜드(Ayn Rand)를 조롱하는 것은 쉽지만, 그녀의 소설 『아틀라스Atlas Shrugged』에서 유명한 “화폐에 대한 찬송”에는 티끌만한 진리가 존재한다.

화폐가 모든 선의 근원이라는 것을 당신이 깨닫지 못하는 한, 당신은 당신 자신의 파멸을 빌고 있는 셈이다. 화폐가 인간이 서로를 대하는 수단이 되기를 그칠 때, 인간은 다른 인간의 도구가 되고 만다. 피, 채찍, 그리고 총, 또는 달러. 선택하라. 다른 선택은 없다.⁴⁾

맑스는 상품들의 세계에서, 어떤 방식으로 “사람들 간의 관계가 사물들 간의 관계라는 형태를 취하게 된다”는 것인지에 대한 그의 유명한 정식에서 비슷한 무엇인가를 말하지 않았던가? 시장경제에서, 사람들 간의 관계는 상호 인정된 자유와 평등의 관계로서 나타날 수 있다. 지배는 더 이상 직접적으로 시행되지 않으며, 바로 그렇기 때문에 가시적이지도 않다. 20세기에 실제로 존재한 사회주의는 시장-소외의 극복이 “소외된” 자유를 폐지하며, 그것으로 자유는 더 말할 것도 없이, 우리를 “소외되지 않은” 직접적인 지배 관계로 되돌아가게 한다는 것을 증명했다. 협력적 공유사회는 어느 정도까지 동일한 위험에 노출되어 있을까? 그들은 협업의 바로 그 매개물을 통제하고, 그 결과 직접적 지배를 행사하는 규제기관 없이도 생존할 수 있을까?

예상된 결과는 다른 분할과 위계질서가 출현한다는 것이다. 전문가와 비전문가, 완전한 시민과 배제된 자, 종교적, 성적, 그리고 다른 소수자들. 따라서 난민들과 “악당 국가들”의 시민들에 이르는, 가치증식의 과정 안으로 아직 통합되지 않은 모든 집단들은 난민 캠프 조직에서 잠재적 위법자로 간주되는 이들에 대한 사법적 통제에 이르기까지 점차적으로 인격적 지배—우리 사회 안으로 난민들의 부드러운 “통합”을 용이하게 하도록 의도된 사회서비스처럼 인간의 얼굴을 취하는 경향이 있는 지배—의 형태로 포섭된다.

왜 이러한 직접적 권위(비민주적인)가 부활하고 있는 것인가? 문화적 차이에 더하여, 문화적 차이를 넘어, 오늘날의 자본주의의 논리 자체에 이러한 부활의 내적인 필요성이 존재한다. 다시 말해서, 우리가 오늘날 직면하고 있는 중심적 문제는 “지적 노동intellectual labor”의 후기자본주의적 우세가 객관적인 조건의 주관적인 재전유로서 혁명에 대해서뿐만 아니라, 그 객관적인 조건으로부터 노동의 분리에 대한 맑스의 기본적인 책략에 어떤 영향을 미치고 있는가? 월드와이드웹 커뮤니케이션 네트워크와 같은 영역에서, 생산, 교환, 그리고 소비consummation은 밀접하게 서로 뒤얽혀 있고, 잠재적으로 동일시되기까지 한다. 나의 생산물은 즉시 전달되며, 다른 사람에 의해 소비된다. “사람들 간의 관계”가 “사물들 간의 관계”의 형태를 취한다는 상품 물신주의에 대한 맑스의 고전적인 관념은 따라서 급진적으로 다시 사유되어야만 한다. “비물질적 노동”에서 “사람들 간의 관계”는 “객관성의 겉치장의 이면에 숨겨져 있는 게 아니라, 그 자체로 우리의 일상적 착취의 소재이다.”⁵⁾ 그래서 우리는 더 이상 고전적인 루카치적 의미에서 “물화(物化)”에 대해 말할 수 없다. 비가시적이기는커녕, 사회적 관계성은 바로 그 유동성에서 직접적으로 마케팅과 교환의 대상이 되고 있다. “문화적 자본주의”에선, 문화적이거나 감정적인 경험을 “가져오는” 대상들을 더 이상 판매(하고 구입)하지 않는다. 대신에 직접적으로 그런 경험을 판매(하고 구입)하게 된다. 그리고 사회적 관계성이 직접적으로 시장에서 판매되므로, 이는 지배의 인격적 관계 역시 직접적으로 시장에서 판매된다는 것을 의미한다. 나는 다른 사람들에게 나의 종으로서 행동하도록 돈을 지불한다. 이러한 자유의 위반을 은폐하고 잘못된 균형을 복원하기 위해 많은 최고 경영자들이 그들에 대한 자기비하의 자학음란증적masochistic 게임을 진행해줄 매춘부들에게 돈을 지불하고 있는 것도 그리 놀라운 일은 아니다.

이 모든 복잡한 결합은 우리로 하여금 노동이 가치의 기원이라는 핵심적 사실을 은폐하는 단순한 외양으로서, 교환 내지는 가치의 구성에서 그 역할을 폐기해야 한다고 주장하는 것으로서 결코 독해될 수 없는, 이른바 “노동가치론”을 다시 사유하지 않을 수 없게 만든다. 만일 우리가 화폐를 그것의 표현에 앞서 상품에서 “그것 자체로” 존재하는 가치의 표현의 부차적 형태로서—즉, 만일 화폐가 우리에게 단순히 부차적인 자원, 교환을 수월하게 하는 실용적 수단이라—간주한다면, 그 문은 좌파-리카도주의자들이 굴복했던 환영(幻影)을 다시 불러들일 여지가 있다. 마치 이러한 직접적 “노동 화폐work money”를 사용하여 모든 “물신주의fetishism”를 피할 수 있고 각각의 노동자는 그들의 “충분한 가치”를 지불받는다는 것을 보장할 수 있는 것처럼, 그들의 담지자에 의해 수행된 작업량을 명시하는, 그리고 그 또는 그녀에게 사회적 생산물의 상응하는 부분에 대한 권리를 부여하는 단순한 증서[시간 전표]로 화폐를 대체하는 것이 가능하리라는 그런 환영인 셈이다. 그러나 맑스의 분석의 요점은 이러한 기획이 물신주의를 필연적 효과로 만드는 화폐의 형식적 결정들을 무시한다는 것이다. 다시 말해, 맑스가 교환가치를 가치의 현상appearance의 양식으로 규정할 때, 여기서 본질과 현상의 대립이라는 전반적으로 헤겔적인 중요성을 동원해야 한다. 본질은 오직 그것이 현상되는 한에서만 존재하며, 그 현상에 대하여 선재하지 않는다. 똑같은 방식으로, 상품의 가치 역시 교환에서 가치의 현상과 무관하게 존재하는 그것의 본래적인 고유성이 아니다.

이것이 또한 왜 우리가 모든 종류의 노동이 가치의 원천으로서 인정되도록 가치를 확장하려는 시도를 포기해야 하는지의 이유이다. 여기선 1970년대부터 가사노동(요리부터 가족을 부양하고 자녀를 돌보기까지)을 가치 생산적인 것으로서 합법화하려는 위대한 페미니스트적 요구, 아니면 물, 공기, 숲, 그리고 다른 모든 공통적인 것의 비용을 결정하려는 시도를 통해 가치 생산 안으로 “자연의 자유로운 선물들”을 일부 통합하려는 일부 동시대의 생태-자본주의적 요구를 상기하는 것으로 충분하다. 이러한 모든 제안은 “자본주의적 생산양식과 자연에 대한 그것의(그리고 우리의) 소외된 관계의 헤게모니에 대한 치열한 공격이 장착될 수 있는 공간의 상품화와 세련된 녹색분칠green-washing에 지나지 않는다.” “공정”해지고, 적어도 착취를 제거하거나 억제하려는 그들의 시도에서, 그러한 시도들은 훨씬 더 강력한 모든 것을 포괄하는 상품화를 단지 강요한다. 그들이 내용의 수준에서 “공정”해지려고 시도한다 해도, 그들은 상품화의 형식 자체를 문제화하는 데 실패한다. 그들은 가치가 비가치non-value와의 변증법적 긴장에서 다루어져야 한다—즉, 가사노동이나 “자유로운” 문화적‧과학적 작업과 같이 그들의 결정적 역할에서 (시장) 가치의 생산에 포획되지 않는 영역을 주장하고 확장하기 위해—는 결론을 단념한다. 가치 생산은 그것이 가치의 내재적 부정, (시장) 가치를 전혀 발생시키지 않는 창조적 작업—규정상 그것은 가치에 기생하고 있다—을 병합하는 경우에만 번창할 수 있다. 그래서 예외들을 상품화하고, 그것들을 가치증식 과정에 포함하는 대신에, 그것들을 [가치의] 외부에 남겨두어야 하고, 가치증식에 관해 그것들의 지위를 열등하게 만드는 틀을 파괴해야 한다. 의제자본이 가진 문제는 그것이 가치증식의 관할외이라는 것이 아니라 그것이 여전히 도래할 가치증식이라는 허구에 기생하고 있다는 것이다.

시장경제에 대한 그 이상의 도전은 우리로 하여금 “물화”와 “상품 물신주의”에 대한 표준적인 맑스주의적 설명을, 이러한 의제가 여전히 그 안정적인 현존이 그것의 사회적 매개를 은폐하는 견고한 대상으로서 물신에 대한 관념에 의존하는 한에서, 철저하게 재정식화하지 않을 수 없게 하는 화폐의 폭증하는 가상화virtualization로부터 비롯된다. 역설적으로, 물신주의는 정확히 물신(物神) 그 자체가 유동적인 “비물질적” 가상적 실체로 바뀌면서 “탈물질화”될 때, 그 절정에 도달한다. 화폐 물신주의는 화폐의 물질성이 최후 흔적이 소멸할 때인, 화폐의 전자적 형태로의 이행과 더불어 정점을 이룬다. 전자 화폐는 직접적으로 그 가치를 구현하는 ‘실질’화폐(‘real’ money) (금, 은)와 어떠한 본래적 가치도 지니고 있지 않은 “단순한 기호”에 불과하지만 여전히 가치의 물질적 실존을 고수하는 종이 화폐를 잇는 제3의 [화폐] 형태이다. 그리고 화폐가 마침내 파괴불가능한 유령적 현존의 형태를 취하는 것은 오직 이 단계, 즉 화폐가 순수하게 가상적인 참조점이 될 때이다. 나는 당신에게 1000달러를 빚지고 있는데, 내가 아무리 많은 물질적 증서를 불태우더라도, 나는 여전히 당신에게 1000달러를 빚지고 있는 것이다. 부채는 가상의 디지털 공간 어딘가에 기입되어 있기 때문이다. 그 어딘가는 오직 이러한 철저한 “탈물질화”를 통해서 『공산주의 선언The Communist Manifesto』에 나오는 맑스의 유명한 옛 테제, 즉 자본주의에서는 “모든 견고한 것이 녹아 대기 중으로 사라진다”는 테제가 맑스가 염두에 두었던 것보다 훨씬 더 글자 그대로의 의미를 획득하는 곳이자, 우리의 물질적인 사회적 현실이 단지 유령적/투기적 자본의 운동에 의해 지배될 뿐만 아니라, 이러한 현실 그 자체가 점차적으로 “유령화되는” 곳이다. 데리다가 자본주의의 유령적 측면이라고 불렀던 것이 완전히 현실화되는 것이 오직 이 지점에서일 뿐이다. 여기서 우리는 낡은 ‘자기동일적 주체self-identical Subject’ 대신에 ‘변화무쌍한 자아Protean Self’, 즉 소유한 대상들의 안정성 대신에 그 경험의 파악하기 어려운 유동성을 갖게 된다. 요컨대 견고한 물질적 대상들과 유동적인 이념들 사이의 평범한 관계성이 뒤집어지고, 대상들은 점차적으로 유동적인 경험들 속에서 용해되는 반면에 안정적인 사물들로 남아 있는 것은 오직 가상의 상징적 의무들일 뿐이다.

하지만 우리가 이미 확인했듯이, 물신의 그러한 유령화spectralization는 그 정반대의 것의 씨앗, 즉 그것의 자기부정을 담고 있다. 바로 직접적인 인격적 지배의 관계의 예기치 않은 귀환이다. 자본주의가 인격적 자유(시장 교환의 조건으로서)를 내포하고 촉진하는 경제적 체계로 자신을 합법화하는 반면에, 자본주의 고유의 동역학은 노예제의 부흥을 초래한다. 중세 말기에 노예제가 거의 사라졌다 해도, 초기 근대성에서부터 미국 시민전쟁까지 유럽 식민지들에서 그것은 다시 폭발적으로 증가했었다. 오늘날 전지구적 자본주의의 신기원이 열리면서, 새로운 노예제 시대 역시 밝아오고 있다. 노예화된 개인의 직접적인 법적 신분은 더 이상 용납될 수 없다 해도, 노예제는 다양한 새로운 형태들을 획득하고 있다. 예컨대, 기초적인 시민권 및 자유를 박탈당한 사우디 반도의 수백만 이주 노동자들이 있으며, 아시아의 노동착취공장에서 수백만 노동자들에 대한 총체적 통제가 종종 직접적으로 강제 수용소와 같이 조직되고 있고, 중앙아프리카의 여러 국가들(콩고 등)에선 자연 자원을 착취하기 위해 강제 노동을 대대적으로 사용하고 있다.

그러나 사실상, 우리는 이러한 국가들까지 주시하지 않아도 된다. 2013년 12월 1일, 피렌체 중심부에서 10킬로미터 떨어진 프라토의 이탈리아 마을의 산업지대에 있는 중국인 소유 의류공장이 노예에 가까운 조건에서 살아가고 일하면서, 내부에 갇혀 있었던 7명의 노동자들을 죽이고 불에 타서 무너졌다. 그래서 우리는 멀리 떨어져 있는 상하이(또는 두바이와 카타르) 교외지역에서 새로운 노예의 비참한 삶을 바라보며, 그들을 수용하는 국가들을 위선적으로 비판하는 사치스러움을 우리들 자신에게 허용할 수 없다. 노예제는 바로 이곳, 우리의 집 내부에 존재할 수도 있는 반면에, 우리는 단지 그것을 보지 않거나 아니면 오히려 그것을 보지 않는 척하고 있다. 이 새로운 아파르트헤이트apartheid, 이 수없이 다양한 형태의 실질적인 노예제의 새로운 체계적 폭증은 비참한 사고가 아니라 오늘날의 전지구적 자본주의의 구조적 필연성이다.

Yes, Yes, Yes가 No가 될 수 있을까?

‘No는 No다’는 평론가들이 현재 진행되고 있는 뉴웨이브 여성해방투쟁을 설명하려고 할 때 내리는 결론 중 하나다. 그런데 이 결론만으로 ‘행복한 성생활’(Happy sex life)이 가능해질까. 좀 더 미묘한 형태의 강요라면 어떨까. 여기 모범 사례가 있다.

“누군가에게 역겨운 복종을 강요하며 괴롭히는 일을 법적으로 해결한다고 해서 그 법이 곧 우리를 행복한 성생활로 인도해주는 것은 아니며 여론 재판으로부터 우리를 보호해주지도 못한다. 틸만*은 젊은이가 추구해야할 덕목이 ‘No’라는 모호한 부재(absence)가 아니라 ‘Yes, Yes, Yes’라는 열정적 현존(presence)이 되어야 한다고 말했다. ‘No는 No’란 말은 시대에 뒤떨어져 보인다. 어떤 사람이 능력이 부족하거나 자신이 없을 경우에 그렇게 말한다면 그 사람은 가장 취약한 곳으로 밀려나 공격받게 될 것이다. 틸만은 “열정적으로 Yes라고 말하지 못하고, 주저하거나, ‘음, 잘 모르겠는데..’라는 태도를 보인다면 그건 바로 No란 뜻”이라고 말한다.” (1)

어떻게 압력 속에서 말해진 약한 ‘yes’는 ‘no’랑 같은 뜻일 수밖에 없는지 등 이 인용문의 핵심 주장들에는 동의할 수밖에 없다. 하지만 문제적인 것은 저 “yes, yes, yes의 열정적 현존”이다. 거칠게 말해 (그러면 좀 어떤가?), 이 열정적 yes라는 조건 때문에 오히려 적극적으로 남성에 의해 눕혀지길 원하는 여성이 모욕감을 느끼는 위치에 놓이게 되는 것을 쉽게 상상해볼 수 있다. 그녀는 이제 “Please fxxx me!”를 공개적으로 말하는 것과 같은 등급의 어떤 것을 수행해야만 하는 것이다. 이렇게 하는 것 외에 열정적 yes를 현존하게 할 더 모호한 (하지만 그럼에도 불구하고 애매할 것 없이 분명한) 방법이 있단 말인가? 더 나아가, “행복한 성생활의 길”을 추구하는 일은 그저 헛되게 끝날 뿐이다. 왜냐하면 그런 것은 없기 때문이다 (There is no such a thing). 섹스는, 그것에 내재한 이유들로 인해서, 종종 잘못되곤 한다. 상대적으로나마 “행복한 성생활”을 누릴 유일한 방법은 이 실수들이 그것들 자체에 대항해서 작동하도록 할 방법을 찾는 길 뿐이다. “행복한 성생활의 길”을 직접적으로 찾아내려는 것은 일을 망가뜨리는 가장 확실한 길이다. 두 파트너가 열정적으로 “예! 예! 예!”를 외치는 상상이란 지옥같은 일이다.

성관계를 포기할 권리에 이르면 문제는 한층 더 복잡해진다. 우리는 이 권리가 어떻게 새로운 폭력의 차원을 여는 지에 대해서는 별로 말을 하지 않는다. 예를 들면 이런 것이다. 여자가 나체로 발기된 채 서 있는 그녀의 파트너를 조롱하며 “당장 꺼져버려”라고 말한다면? 반대로 남자도 똑같이 한다면? 이보다 더 굴욕적인 경우가 있을까? 이런 교착상태에 대한 적절한 해결 방법은 법이 아니라 서로에 대한 매너와 섬세함이다. 계약서에 새로운 조항을 추가하는 것으로 폭력과 강압을 피할 수 있다고 생각한다면, 말해지는 것과 말해지지 않는 것 사이의 미묘한 균형이라는 성관계의 핵심 특징을 잃어버리게 된다.

원하는 걸 노골적으로 말하지 않을 때, 격정의 폭발이 공손함으로 가려질 때, 온건한 무력이 성적 친밀함으로 통할 때, 성관계는 이러한 순간들에 대한 무언의 이해와 기지라는 예외성으로 가득 차 있다. 결국 열정적인 “Yes, Yes, Yes”가 사실상 폭력과 지배의 마스크로 기능하고 있다는 것이다. 모니카 르윈스키(Monica Lewinsky)는 2014년 저서에서 “원하지 않는 관계였지만 거대한 힘의 차이를 생각하지 않을 수 없었다. 그때 나는 결론이 어떻게 될지에 대한 이해가 전혀 없었다”며 날마다 그 일을 후회하고 있으며 “‘동의’의 사전적 의미는 뭔가 일어나도록 허용하는 것이다. 하지만 그때 내 나이에 그의 권력과 사회적 위치 앞에서 그 ‘뭔가’란 무엇일까? 그는 내 보스였다. 지구상에서 가장 파워풀한 남자였고, 나보다 27살이나 많았고, 뭐가 더 나은지 알 수 있는 풍부한 경험이 있었다.”라고 썼다.(2)*

맞는 말이다. 하지만 그녀는 그냥 동의했다기보다, 적극적으로 성적 접촉을 시작했다. 오히려 ‘동의’한 쪽은 거대한 힘의 차이(그녀에게 매력 포인트였을)를 가진 클린턴이었다. 그녀의 주장은 뭐가 더 좋은 지 잘 아는 훨씬 풍부한 경험을 가진 남자가 자신의 ‘들이댐’을 거절해야했다는 것이다. 스스로 부여한 이 순결한 희생자 역할이 어쩐지 도덕적으로 표리부동한 것은 아닌가?

이런 생각이 정확히, 거의 대칭적으로, ‘강간범을 은밀하게 유혹한(도발한) 여자가 문제다’라는 무슬림 근본주의자의 반대편에 놓여 있는 견해라는 것을 알 수 있지 않은가? 여자가 도발해서 강간이 일어났다는 논리는 미디어에 자주 등장한다. 2006년 가을, 호주의 가장 명망있는 시니어 무슬림 성직자인 세이크 타지 딘 알-힐라리(Sheik Taj Din al-Hilali)*는 강간범이 수용되어 있는 감옥에서 “길바닥에 떨어진 고깃덩어리를 지나가는 고양이가 먹어 치웠다면 고깃덩어리 잘못인가. 고양이 잘못인가?”라고 말해 논란을 일으켰다. 베일을 안 쓴 여성을 길가에 떨어진 고깃덩어리에 대입시킨 이 노골적 비유는 즉시 폭발적인 스캔들이 됐다. 그런데 이 논쟁에는 더 놀라운 전제가 숨어 있다. 남자의 성행위가 온전히 여자 책임이라면, 남자는 고깃덩어리를 본 고양이처럼 저항할 수 없는 성적 도발에 완전히 무기력한 성욕의 노예가 된다는 게 아닌가? 성행위에 남자가 완전히 무책임하다는 이러한 가정과는 대조적으로, 서구에서는 여성의 공공연한 성적 매력을 강조한다. 성욕의 맹목적 노예가 아닌 절제할 수 있는 남자가 있다는 전제로 말이다.

여자에게 성행위의 책임을 온전히 전가하는 것은, 클린턴에게 모든 책임(주도권이 그녀에게 있었음에도 불구하고)을 전가하는 르윈스키의 관점과 기묘한 거울상을 이룬다. 무슬림 근본주의자*의 관점에서는 흉포한 강간범이라도 여자의 유혹에 속아 넘어간 무기력한 희생자다. 르윈스키의 관점에서 자신은 먼저 도발적으로 관계를 시작했다고 하더라도 희생자다. 물론 이 대칭은 오류다. 두 경우 모두 사회를 실제로 지배하는 권력자는 남성이기 때문이다. 그럼에도 불구하고 르윈스키 케이스 같이 무기력한 희생자라는 카드를 만지작거리는 것은 여성 해방과 전혀 관계없다. 그것은 여성 스스로 자신을 모독하는 스펙터클일 뿐이다. 그것은 남성이 주인이라는 걸 확인시켜 주는 것이다.

CAN EVEN A "YES, YES, YES" MEAN "NO"?

When commentators try to resume the results of the ongoing new wave of the struggle for women's emancipation, one of their conclusons is that “no means no” is not enough to lead a “happy sex life” since it still leave the space open for more subtle forms of coercion – here is an exemplary case of this line of argumentation:

“Badgering someone into queasy submission might technically be within the law, but it is not the road to a happy sex life and it may no longer protect a man from public censure. What young men should look for, Tillman argues, is not the potentially ambiguous absence of “no”, but the enthusiastic presence of a “yes, yes, yes” or affirmative consent. “In 2018, ‘no means no’ is totally antiquated. It puts all the pressure on the person in the most vulnerable position, that if someone doesn’t have the capacity or the confidence to speak up, then they’re going to be violated,” she says. “If somebody isn’t an enthusiastic yes, if they’re hesitating, if they’re like: ‘Uh, I don’t know’ – at this point in time, that equals no.””

One cannot but agree with all the critical points in this passage: how a weak “yes” under pressure equals “no,” etc. What is problematic is “the enthusiastic presence of a ‘yes, yes, yes’” – it is easy to imagine in what a humiliating position this condition can put a woman who, to put it bluntly (and why not?), passionately wants to get laid by a man – basically, she has to perform an equivalent of publicly stating “Please f*** me!”… Are there not much more subtle (but nonetheless unambiguously clear) ways to do this? Furthermore, if one looks for “the road to a happy sex life,” one looks for it in vain for the simple reason that there is no such thing: things always, for immanent reasons, go wrong in some way in sex, and the only chance of a relatively “happy sex life” is to find a way to make these failures work against themselves. Directly searching for “the road to a happy sex life” is the safest way to ruin things, and the imagined scene of both partners enthusiastically shouting “yes, yes, yes” is in real life as close as one can get to hell.

Things get even more complex with the right to withdraw from sexual interaction at any moment - one rarely mentions how thsi right opens up new modes of violence. What if the woman, after seeing her partner naked with erected penis, begins to mock him and tells him to leave? What if the man does the same to her? Can one imagine a more humiliating situation? Clearly, one can find an appropriate way to resolve such impasses only through manners and sensitivity, which by definition cannot be legislated. If one wants to prevent violence and brutality by adding new clauses to the contract, one loses a central feature of sexual interplay which is precisely a delicate balance between what is said and what is not said. Sexual interplay is full of such exceptions where a silent understanding and tact offer the only way to proceed when one wants things done but not explicitly spoken about, when extreme emotional brutality can be enacted in the guise of politeness and when moderate violence itself can get sexualized.

If we go to the end on this path, we have to conclude that even an enthusiastic »yes, yes, yes« can effectively function as a mask of violence and domination. Monica Lewinsky recently said that “she stands by her 2014 comments that their relationship was consensual, but muses about the "vast power differentials" that existed between the two. Ms Lewinsky says she had "limited understanding of the consequences" at the time, and regrets the affair daily. "The dictionary definition of "consent"? To give permission for something to happen," she wrote. "And yet what did the 'something' mean in this instance, given the power dynamics, his position, and my age? /.../ He was my boss. He was the most powerful man on the planet. He was 27 years my senior, with enough life experience to know better."”

True, but she did not just consent, she directly initiated sexual contact, and it was Clinton who “consented,” and the “vast power differential” was what probably a key part of his attraction for her. As for her claim that since he was an older experienced man, he should have “known better” and reject her advances, is there not something hypocritical in this self-ascribed role of an inexperienced victim? Do we not fund ourselves here at the exact, almost symmetrical, opposite of the Muslim fundamentalist view according to which a man who raped a woman was secretly seduced (provoked) by her into doing it? Such a reading of male rape as the result of woman's provocation is often reported by the media. In the Fall of 2006, Sheik Taj Din al-Hilali, Australia’s most senior Muslim cleric, caused a scandal when, after a group of Muslim men had been jailed for gang rape, he said: »If you take uncovered meat and place it outside on the street /…/ and the cats come and eat it… whose fault is it – the cats’ or the uncovered meat? The uncovered meat is the problem.« The explosively-scandalous nature of this comparison between a woman who is not veiled and raw, uncovered meat distracted attention from another, much more surprising premise underlying al-Hilali’s argument: if women are held responsible for the sexual conduct of men, does this not imply that men are totally helpless when faced with what they perceive as a sexual provocation, that they are simply unable to resist it, that they are totally enslaved to their sexual hunger, precisely like a cat when it sees raw meat? In contrast to this presumption of the complete lack of male responsibility for their own sexual conduct, the emphasis on public female eroticism in the West relies on the premise that men are capable of sexual restraint, that they are not blind slaves of their sexual drives.

This total responsibility of the woman for the sexual act strangely mirrors the Lewinsky view that, although the initiative was fully on her side, the responibility was fully Clinton's. In the same way that, in the Muslim fundamentalist view, men are helpless victims of woman's perfidious seduction even if they commit a brutal rape, in the Lewinky case, she was a victim even if she provicatively initiated the affair. The symmetry between the two cases flawed, of course, since in both of them men are in the actual position of social power and domination. However, playing the card of a helpless victim in such a case as Lewinsky's is a self-humiliating spectacle which in no way helps women's emancipation – it merely confirms man as the master.

파리(와 그 밖의 지역)에서의 1968년 5월 사건 이후 반세기가 지났다. 바야흐로 1960대의 성적 자유와 페미니즘, 그리고 현재 번성하는 저항운동인 LGBT+나 MeToo 간의 유사점과 차이점에 대해 숙고할 때가 왔다.

68의 여파로 프랑스의 진보 언론은 어린이와 성인을 분리하는 인위적이고 억압적인 문화적 제한의 경계를 폐지할 것과 신체의 자유가 어린이들에게까지 확장될 권리를 주장하면서 소아성애(pedophilia)의 비범죄화를 요구하는 일련의 청원을 발표했다. 사르트르, 보브와르, 데리다, 바르트, 푸코, 아라공, 가타리, 들뢰즈, 리오타르 등이 서명한 이러한 조처를 반대하는 것은 ‘반동’과 억압의 어두운 세력의 편에 서게 되는 것인지도 모른다. 반면, 오늘날 소아성애는 최악의 범죄 중 하나로 인식되고 있는데 이것은 가톨릭 교회의 어두운 면과 연관돼 있다. 그래서 ‘안티 가톨릭 진보’라는 이름으로 싸우는 것보다 소아성애에 맞서 싸운다는 것이 곧 반동의 세력과 싸우는 진보의 책무가 된다. 여전히 60년대 올드 스피릿으로 살고 있는 다니엘 콘-벤디(Daniel Cohn-Bendit)*는 이런 전환의 희극적 희생자다. 그는 최근 한 인터뷰에서 유치원에서 일하던 젊은 시절 어린 소녀들과 정기적으로 자위 게임을 했다고 털어놓은 사실 때문에 의회의 제명과 기소를 요구하는 거센 역풍을 맞았다.

68의 성적 자유와 현재의 성해방 투쟁 사이에 가로 놓인 이러한 격차는 MeToo+운동에 비판적 언급을 한 저메인 그리어(Germaine Greer)*와 이에 신속한 반응을 보인 일부 페미니스트들의 논쟁에서 확연히 드러난다. 이들의 요점은 그리어의 주장(여성 스스로 남성의 지배로부터 자유로와야 하며 어떤 피해자 의식도 없이 능동적인 성생활을 추구해야 한다)이 1960년대와는 달리 더 이상 유효하지 않다는 것이다. 그 사이 무슨 일이 일어났는가? 여성의 성해방(성에 대해 자기 주도권을 가진 능동적 주체로서 여성)이 상품화됐다는 것이다. 맞다. 여성은 더 이상 남성의 수동적 대상이 아니다. 하지만 동시에 여성의 능동적 섹슈얼리티는 (남성의 눈에) 언제든지 섹스를 할 수 있게 준비된 것으로 보인다. 이러한 새로운 상황에서 단호히 ‘No’라고 말하는 것은, 새로운 형태의 성주체성에 대한 요구, 즉 남성의 성적 지배에 수동적으로 응하는 것만이 아니라 능동적으로 원하는 것처럼 보여야 한다는 요구를 거절하는 것이기 때문에 단순한 ‘피해자되기’라고 할 수 없다.

이 논점에 비록 강한 진실의 요소가 있다고 하더라도, 누군가 피해자가 되는 상황이 누군가의 정치적 요구에 지나치게 권위를 부여한다는 것 또한 문제가 있다는 것을 인정해야 한다. 운명을 스스로 온전히 책임지는 자유로운 주체가 아니라 자기 통제를 벗어난 피해자성의 권위에 의지해야 하는 것이 오늘날 주체성의 기본적 특징일까. 타인과 접촉하는 모든 순간이 잠재적 위협으로 다가온다면 어떤가. 누군가 내 앞에서 담배를 피거나 내게 탐욕스런 눈길을 던진다면 그는 이미 나를 해친 것일까. 이러한 피해자 논리는 성과 인종에 가해지는 전형적 추행 사례를 넘어 보편적이 됐으며 피해보상을 지급하기 위한 금융 산업의 성장을 부추기고 있다. 책임 없는 피해자로서의 주체성이란 개념은 극단적 나르시시스트의 관점과 이어진다. 타인과 만나는 모든 순간이 주체의 불안한 균형을 무너트리는 잠재적 위협으로 나타난다. 역설적인 것은 오늘날 개인주의가 지배적 상황에서 이런 심리주체의 자기중심적 주장이 자신을 피해자로 여기는 인식과 일치한다는 사실이다.

‘정치적으로 올바른’ 문화 좌파가 글로벌 자본주의에 완전히 몰입하고 있다는 사실을 가리기 위해 문화 및 성차별적인 ‘분리정책’(apartheids)에 대항하는 전투를 끊임없이 벌임으로써 지나치게 열광적으로 ’진보’를 옹호하고 있다는 의심을 없앨 수 없다. 그 공간은 LGBT+와 MeToo가 팀 쿡과 빌 게이츠와 만나는 공간이다. 어째서 그런가? 많은 보수주의자들이 주목하듯이(그리고 그들은 이 점에서 옳다), 이 시대는 조지 오웰이 말한 “공공의 품위”(common decency)에 기반한 공유 네트워크라는 관습의 점진적 붕괴로 특징 지워진다. 이런 관습은 개인의 자유를 원파시스트(protoFascist)의 유기적 사회체에 종속시키는 멍에로 일축된다. 이와 같은 상황에서 진보적 비전이 추구하는 최소한의 법(사회생활을 지나치게 규제해서는 안 되고 타인의 침해로부터 개인을 방어해야 한다)은 “모든 형태의 차별에 반대하는 투쟁”이란 이름 아래 입법화/도덕화의 과정을 거쳐 끝없는 법과 도덕 규칙의 폭발로 역전돼 나타난다. 법에 영향을 주는 공통적 관습이 더 이상 남아있지 않다면 결국 괴롭힌다는 사실만이 남을 것인데 그러한 관습이 부재한 상태에서 누가 무엇을 ’괴롭힘’(harassment)으로 간주할 것인지 결정할 것인가? 프랑스에는 비만인의 자존심을 상하게 하기 때문에 비만과 건강한 식습관에 대한 모든 공개 캠페인을 중단할 것을 요구하는 비만인 단체가 있다. 베지 프라이드(Veggie Pride) 군단은 육식을 하는 ‘종차별주의자’(speciesism) (동물을 차별하고 인간 동물에게 특권을 부여하는 파시즘의 특히 역겨운 면)들을 경멸하며 ‘채식혐오증’(vegetophobia)은 외국인혐오증과 마찬가지로 범죄라고 선포했다. 그밖에 근친 결혼, 합의 살인, 식인 풍습 등등...

여기서 문제는 이러한 새로운 규칙이 명백히 임의적이라는 것이다. 아동성문제에 관해 누군가는 범죄화하는 것이 부당한 차별이라 주장하고 또 다른 누군가는 성추행으로부터 어린이를 보호해야 한다고 주장한다. 소프트 마약의 합법화를 옹호하는 사람들(공공장소에서의 흡연은 반대하지만)이나 아동에 대한 가부장적 폭력에 반대하는 사람들 모두 이질적인 외국인 문화혐오(로마 집시들이 아이들의 공립학교 진학을 방해한다든지)에 우려를 표한다. 다른 사람들의 삶의 방식에 간섭하지 말자는 것이다. 이런 문맥에서 나타나는 “반차별투쟁”은 최종 지점을 끝없이 유예하는 무한한 과정이다. 그 최종 지점이란 쟝 클로드 미셰(Jean-Claude Michea)가 말한 대로 “어떤 사회를 범죄의 온상으로 저주하게 만드는 생각에 위치한” 도덕적 편견으로부터 자유로운 사회일 것이다.

따라서 이러한 과도한 도덕주의가 어떻게 글로벌 자본주의 시스템 수용의 표면이 되는지 따져보는 것이 중요하다. 오프라 윈프리(Oprah Winfrey)의 골든 글로브 수상 소감은 그녀를 트럼프에 맞설 민주당의 2020년 잠재적 대선후보 궤도에 올릴만큼 청중을 매료시켰다. 그녀의 연설은 정치에서 잘못된 이유로 올바른 일을 하는 모델이다. 성추행을 폭로할 수 있는 특권을 가진 여배우들로부터 훨씬 더 많은 일상의 잔인한 폭력에 노출된 수많은 보통 여성들에게 관심을 돌려야 한다는 그녀의 요구는 옳다. 하비 와인스틴(Harvey Weinstein)을 비롯해 수많은 유명인들이 성추행으로 기소되면서 자신들은 그저 치료가 필요할 뿐이라는 변명을 지켜보는 것은 정말 역겹다. 그들의 행위는 사적 병리현상이 아니다. 그것은 반드시 바뀌어야 할 남성 지배 이데올로기와 권력 구조다.

잘못된 이유는 자유주의자로서 오프라가 여성의 위대한 각성과 현재의 정치적, 경제적 갈등 간의 연결 고리를 무시한다는 것이다. 와인스틴의 스캔들이 터진 시점과 거의 동시에 파라다이스 페이퍼(Paradise Papers)*가 발표됐는데, 아무도 막대한 규모의 탈세를 한 U2의 Bono(위대한 인도주의자이자 항상 가난한 아프리카 사람들을 돕기 위해 준비된)와 샤키라(Shakira)의 노래를 듣지 말자고 주장하지 않는다. 루이 CK(Louis CK)*가 여성들에게 성기를 노출해 경력을 완전히 날려 버리는 동안에 말이다. 또한 조세 피난처에 부를 축적한 영국 왕실의 재정을 줄여야 한다고 요구하지도 않는 점도 의아할 따름이다. 이것은 브레히트의 옛 경구인 “은행 강도가 어때서? 은행을 설립하는 건 괜찮은가?”의 새로운 버전 아닌가? 몇 사람에게 성기를 노출한 코미디언은 즉시 매장되면서 막대한 돈을 사기치는 일은 참아 줄 만한 것인가?

*저메인 그리어(Germaine Greer 1939~ )는 오스트레일리아 태생의 작가, 교수, 저널리스트이자 20세기 후반의 가장 중요한 페미니스트이다. 1970년 발간된 베스트셀러 [여성 거세당하다]에서 여성의 성을 다룬 것으로 유명하다.

*패러다이스 페이퍼스(Paradise Papers)는 국제탐사보도언론인협회(ICIJ)가 2017년 11월 5일 조세회피처로 유명한 영국령 버뮤다의 로펌 ‘애플비’(Appleby)의 1950년~2016년의 내부자료를 입수해 폭로한 문건에 붙인 이름이다.

*루이 CK(Louis CK 1967~ )는 미국의 유명 코미디언이다. 2017년 뉴욕타임스가 성폭력 사실을 폭로했다. 그는 2002년 코미디쇼가 끝난 후 호텔방으로 초대된 여성 코미디 듀오인 다나 민 굿맨과 줄리아 월로브 앞에서 자위행위를 했다고 한다. 당시 루이 CK는 방에 들어선 굿맨과 윌로브에게 그들이 보는 앞에서 자위 행위를 해도 되냐고 물었다고 한다. 굿맨은 당시 그의 제안을 농담으로 받아들이고 웃음으로 넘겼지만 "그는 실제로 옷을 벗더니 자위 행위를 했다"고 밝혔다. 그가 평소 페미니즘을 옹호하는 발언을 많이 했기 때문에 미국 사회에 충격을 준 사건이다.

SEXUAL LIBERATION, 1968 and 2018

Half a century after the May ’68 events in Paris (and elsewhere), the time has come to reflect upon similarities and differences between the sexual liberation and feminism of the 1960s and the protest movements that flourish today, from LGBT+ to MeToo.

In the aftermath of ‘68, the French “progressive” press published a whole series of petitions demanding the decriminalization of pedophilia, claiming that in this way the artificial and oppressive culturally-constricted frontier that separates children from adults will be abolished and the right to freely dispose with one’s body will be extended also to children, so only dark forces of “reaction” and oppression can oppose this measure – among the signatories were Sartre, de Beauvoir, Derrida, Barthes, Foucault, Aragon, Guattari, Deleuze, Lyotard… Today, however, pedophilia is perceived as one of the worst crime and, instead of fighting for it in the name of anti-Catholic progress, it is rather associated with the dark side of the Catholic church, so that fighting against pedophilia is today a progressive task directed at the forces of reaction… The comic victim of this shift was Daniel CohnBendit, still living in the old spirit of the 60s, recently described in an interview how, while, in his young years, he worked in a kindegarten, he regularly played masturbatory games with young girls; to his surprise, he faced a brutal backlash, demanding his removal from the European parliament and prosecution.

This gap that separates the ’68 sexual liberation from today’s struggle for sexual emancipation is clearly discernible in a recent polemical exchange between Germaine Greer and some feminists who swiftly reacted to her critical remarks on MeToo. Their main point was that, while Greer’s main thesis – women should sexually liberate themselves from male domination and assume active sexual life without any recourse to victimhood – was valid in the sexual-liberation movement of the 1960s, today the situation is different. What happened in between is that sexual emancipation of women (their assuming social life as active sexual beings with full freedom of initiative) was itself commodified: true, women are no longer perceived as passive objects of male desire, but their active sexuality itself now appears (in male eyes) as their permanent availability, readiness to engage in sexual interaction. In these new circumstances, saying brutally NO is not a mere self-victimization since it implies the rejection of this new form of sexual subjectivization of women, of demanding of women not only to passively submit to male sexual domination but to act as if they actively want it.

While there is a strong element of truth in this line of argumentation, one should nonetheless also admit how problematic it is too ground the authority of one’s political demands on one’s victimhood status. Is the basic characteristic of today's subjectivity not the weird combination of the free subject who experienced himself as ultimately responsible for his fate and the subject who grounds the authority of his speech on his status of a victim of circumstances beyond his control? Every contact with another human being is experienced as a potential threat - if the other smokes, if he casts a covetous glance at me, he already hurts me; this logic of victimization is today universalized, reaching well beyond the standard cases of sexual or racist harassment - recall the growing financial industry of paying damage claims… This notion of the subject as an irresponsible victim involves the extreme Narcissistic perspective: every encounter with the Other appears as a potential threat to the subject's precarious balance. The paradox is that, in today's predominant form of individuality, the self-centered assertion of the psychological subject paradoxically overlaps with the perception of oneself as a victim of circumstances.

One cannot get rid of the suspicion that the Politically Correct cultural Left is getting so fanatical in advocating “progress,” in fighting new and new battles against cultural and sexist “apartheids,” to cover up its own full immersion into global capitalism. Its space is the space in which LGBT+ and MeToo meet Tim Cook and Bill Gates. How did we come to this? As many conservatives noticed (and they are right here), our time is marked by the progressive disintegration of a shared network of customs which ground what George Orwell approvingly referred to as “common decency” - such standards are dismissed as a yoke that subordinates individual freedom to some proto-Fascist organic social forms. In such a situation, the liberal vision of minimalist laws (which should not regulate social life too much but just prevent individuals to encroach upon - to “harass” - each other) reverts into an explosion of legal and moral rules, into an endless process of legalization/moralization called “the fight against all forms of discrimination.” If there are no shared mores that are allowed to influence the law, only the fact of “harassing” other subjects, who – in the absence of such mores – will decide what counts as “harassment”? There are, in France, associations of obese people which demand that all public campaigns against obesity and for healthy eating habits be stopped, since they hurt the self-esteem of obese persons. The militants of Veggie Pride condemn the “specieism” of meat-eaters (who discriminate against animals, privileging the human animal – for them, a particularly disgusting form of “fascism”) and demand that “vegetophobia” should be treated as a kind of xenophobia and proclaimed a crime. And so on and so on: incest-marriage, consensual murder and cannibalism…

The problem is here the obvious arbitrariness of the ever new rules – let us take child sexuality: one can argue that its criminalization is an unwarranted discrimination, but one can also argue that children should be protected from sexual molestation by adults. And we could go on here: the same people who advocate the legalization of soft drugs usually support the prohibition of smoking in public places; the same people who protest against the patriarchal abuse of small children in our societies, worry when someone condemns members of foreign cultures who live among us for doing exactly this (say, Romas – Gypsies - preventing children from attending public schools), claiming that this is a case of meddling with other “ways of life”… It is thus for necessary structural reasons that this “fight against discrimination” is an endless process endlessly postponing its final point, a society freed of all moral prejudices which, as Jean-Claude Michea put it, “would be on this very account a society condemned to see crimes everywhere.”

So it is crucial to see how this excessive moralism is the obverse of the acceptance of global capitalist system. Oprah Winfrey’s triumphant speech at the Golden Globe awards enthralled the public so much that it brought her into the orbit as a potential Democratic presidential candidate against Trump in the 2020 elections. Her speech is a model of doing the right thing for the wrong reason in politics. The right thing was her demand to shift the focus from privileged actresses complaining about sexual harassment to millions of ordinary women who are exposed to much more vicious daily violence. Remember how many of the celebrities accused of sexual harassment, beginning with Harvey Weinstein, reacted by publicly proclaiming that they will seek help in therapy – a disgusting gesture if there ever was one! Their acts were not cases of private pathology, they were expressions of the predominant masculine ideology and power structures, and it is the latter that should be changed.

The wrong reason is that Oprah as a liberal ignored the link between this great awakening of women and our ongoing political and economic struggles. At approximately the same time as the Weinstein scandals began to roll, Paradise Papers were published, and one cannot but wonder why nobody demanded that people should stop listening to the songs of U2 and Bono (the great humanitarian, always ready to help the poor in Africa) or of Shakira because of the way they avoided paying taxes and thus cheated the public authorities of large sums of money, or that the British royal family should get less public money because they parked part of their wealth in tax oases, while the fact that Luis CK showed his penis to same ladies instantly ruined his career. Isn’t this a new version of Brecht’s old motto “What is robbing a bank compared to founding a bank?”? Cheating with big money is tolerable while showing your penis to a couple of persons makes you an instant outcast?
